Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website at ebsportsrecruiting.com, the Athlete Portal, and any related services we provide (collectively, the "Site"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Who We Are

EB Sports Recruiting ("we," "us," or "our") is an Ohio-based recruiting services business operated by Eric Brown, based in Columbus, Ohio. Contact: eric@ebsportsrecruiting.com, (614) 316-0120.

2. Who Can Use the Site

You may use the public marketing pages of the Site if you are 13 or older. The Athlete Portal requires an account. There are two ways an account can be created:

• Free Athlete Profile (self-registration). An athlete or their parent/legal guardian may create a free athlete profile at ebsportsrecruiting.com/register.html. If the athlete is under 18, the registration must be completed by, or with the knowledge and consent of, a parent or legal guardian; by completing it, the registrant confirms that consent has been given. See Section 3.3 for what a Free Athlete Profile includes.
• Client accounts. Athletes and families engaged with EB Sports Recruiting under a signed Recruiting Services Agreement, and family members designated by them, are granted Portal access by EB Sports Recruiting.

In all cases, account holders must be 13 or older and must provide accurate information when registering and signing in. We may decline, suspend, or remove any account or profile at our discretion, including where we cannot reasonably confirm parental consent for a minor.

3. Intellectual Property

3.1 Our content

All content on the Site that is created by EB Sports Recruiting — including the EB Sports Recruiting name, logo, branding, written content, photos, graphics, layout, and code — is owned by EB Sports Recruiting and protected by U.S. copyright and trademark law. You may not copy, distribute, modify, or use our content for any commercial purpose without our prior written permission. You may, of course, share links to our public pages on social media or in personal communications.

3.2 Athlete profiles and user content

The Site hosts publicly viewable athlete profiles: for engaged clients who have opted in, and for athletes who create a Free Athlete Profile themselves (Section 3.3). The athlete (and their parent, stepparent, or legal guardian) retains ownership of their name, image, photos, video, statistics, and personal information ("Athlete Content"). By providing Athlete Content to us, whether through a signed engagement or by self-registering and filling out a profile, the athlete and their family grant EB Sports Recruiting a non-exclusive, royalty-free license to host, use, display, share with college coaches, and publish that content as part of the recruiting services. For paying clients, the details of this license are governed by the signed Recruiting Services Agreement; for Free Athlete Profiles, the license is granted under these Terms and lasts until the profile is removed.

Visitors to the Site may not copy, download, scrape, or republish Athlete Content without explicit permission from the athlete and EB Sports Recruiting.

3.3 Free Athlete Profiles

Creating a Free Athlete Profile publishes a public athlete profile page that anyone on the internet, including college coaches, can view. This is acknowledged at registration and is the point of the profile. A Free Athlete Profile also includes access to the Athlete Portal, where the athlete and family can update the profile, upload highlight film, enter stats and athletic history, choose which individual fields are shown or hidden on the public page, and switch the public page on or off at any time.

Search engines can find published profiles. While a profile is switched on, it may be crawled and listed by search engines such as Google, which means it can appear in search results for the athlete's name. Switching the profile off removes the page going forward, but search engines may take several weeks to drop a listing they have already indexed, and we do not control their timing. Only the fields chosen as visible in the Portal are ever published; hidden fields are removed before the page is sent.

• Free Athlete Profiles are free of charge and require no approval. They do not create a client engagement, and EB Sports Recruiting has no obligation to provide recruiting services, coach outreach, or evaluations to free-profile holders.
• The athlete and family control the profile's content and per-field visibility from the Portal, and can take the whole public page offline themselves at any time using the Public Profile switch in the Portal. Switching it off takes effect immediately: the page stops loading for anyone who visits the link. To delete the underlying record entirely rather than just unpublish it, email eric@ebsportsrecruiting.com and we will remove it promptly.
• We may edit, unpublish, or delete any profile that contains inaccurate, inappropriate, or infringing content, or that otherwise violates these Terms.
• Information submitted at registration becomes part of our recruiting database, governed by these Terms and our Privacy Policy, and Eric may contact you about your recruiting journey using the contact details you provide.

3.4 Contact form submissions

The Contact form at ebsportsrecruiting.com/contact.html is a recruiting-inquiry intake. When you submit it:

• The submission is automatically logged in our recruiting system and a preliminary athlete record is created so Eric can review and follow up.
• The information you provide (athlete name, sport, school, graduation year, parent/guardian contact info, and any free-text message) becomes part of our recruiting database, governed by this policy and our Privacy Policy.
• Eric or a member of his team may contact you using the email address or phone number you provided to discuss potential services. You can ask us at any time to stop contacting you or to delete the inquiry by emailing eric@ebsportsrecruiting.com.
• Submitting the form does not create a business relationship or any obligation to provide services. A formal engagement begins only when both parties sign the Recruiting Services Agreement.

4. Athlete Portal Accounts

The Athlete Portal is a private, login-protected area of the Site. We use a magic-link sign-in system: when you enter your authorized email, we email you a one-time link that signs you in for that session. There is no permanent password to remember or lose.

Each athlete record may grant Portal access to up to five (5) authorized email addresses (the athlete and/or parents, stepparents, or other family members designated by the family). For client accounts, Eric grants and revokes access from within the athlete's profile in our admin system; for Free Athlete Profiles, the email(s) provided at registration receive access automatically.

If you are given access to the Portal:

• You are responsible for keeping your sign-in credentials and email account secure. Do not share your magic-link emails with anyone else.
• You agree to use the Portal only to view information related to your own athlete (or, for admin accounts, all athletes you are authorized to manage).
• You agree not to attempt to access information about other athletes, other families, or other admin accounts.
• You agree not to interfere with the Portal's security, scrape data programmatically, or attempt to bypass access controls.
• Authorized family members may view their athlete's profile, college list, scheduled tasks (the "EB Recruiting Plan"), and coach-communication log. Family members may log new coach-communication entries for their own athlete and edit or delete only entries they themselves created; communication entries logged by Eric or other authorized users remain read-only.
• We may suspend or revoke any Portal account that we reasonably believe is being misused, with or without notice.

5. Acceptable Use

When using the Site, you agree not to:

• Impersonate another person or misrepresent your relationship to an athlete;
• Submit false, misleading, or fraudulent information through any form or the Portal;
• Use the Site to harass, threaten, or defame any person, including college coaches, EB Sports staff, athletes, or families;
• Upload, send, or post any content that is unlawful, infringing, obscene, hateful, or otherwise objectionable;
• Attempt to gain unauthorized access to any portion of the Site, the Athlete Portal, or the underlying database;
• Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission;
• Use the Site for any commercial purpose other than your engagement with EB Sports Recruiting;
• Use the Site in any way that violates a law or governing-body rule, including NCAA, NAIA, OHSAA, or state recruiting and NIL rules.

6. Communications with College Coaches

If EB Sports Recruiting facilitates communication between you and a college coach or program, those communications are between you and the coach. We do not control what coaches say or do, and we do not guarantee any coach's response, interest, or offer.

7. Scheduling, Payments, and Third-Party Services

We rely on several third-party services to deliver the Site and our recruiting services, including Supabase (database and authentication), Resend (transactional email delivery), Stripe (payments), Cal.com (scheduling), Cloudflare (hosting, security, analytics), Netlify (static-site hosting), and Microsoft 365 (Eric's mailbox at eric@ebsportsrecruiting.com). Each of these services has its own terms of service and privacy policy that govern your use of them. We are not responsible for outages, errors, or issues with those third-party services. Recruiting Services Agreements generated through our admin system are stored privately in our cloud storage and made available to the family for download. Signed copies uploaded back to the system are similarly stored privately.

8. Disclaimers

The Site and all information on it are provided "as is" and "as available", with no warranties of any kind, express or implied. We do not warrant that:

• The Site will be uninterrupted, secure, or error-free;
• Information on the Site is accurate, complete, or up to date;
• Use of the Site will result in any scholarship, roster spot, admissions outcome, financial-aid package, or NIL deal for any athlete;
• Any specific outcome will be achieved through use of our services.

We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by Ohio law:

• EB Sports Recruiting, its owner, employees, and contractors are not liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Site, including lost scholarships, lost roster spots, lost playing time, lost opportunities, lost data, or emotional distress.
• Our total liability for any claim arising out of or related to the Site, in the aggregate, is limited to one hundred U.S. dollars ($100), or, if you are a paying client, the total fees you paid to us in the twelve (12) months immediately preceding the claim — whichever is greater.
• The limitations in this Section apply even if a limited remedy fails of its essential purpose.

10. Indemnification

You agree to indemnify, defend, and hold harmless EB Sports Recruiting, Eric Brown, and any contractors or employees from any third-party claim, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Site, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) any content you submit through the Site.

11. Third-Party Links

The Site may contain links to external websites (such as Hudl, MaxPreps, college athletic pages, or social-media platforms). We do not control those websites, do not endorse their content, and are not responsible for their privacy practices, terms, or content. Visit them at your own risk.

12. Suspension or Termination

We may suspend or terminate your access to the Site or the Athlete Portal at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. If you are a paying client, termination of Site access does not automatically terminate the Recruiting Services Agreement, and vice versa.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any dispute arising out of or related to the Site or these Terms must be brought in the state or federal courts located in Franklin County, Ohio, and you consent to the jurisdiction of those courts.

Before filing any lawsuit, you agree to first attempt to resolve the dispute by contacting Eric Brown directly at eric@ebsportsrecruiting.com and giving us at least thirty (30) days to respond and attempt resolution in good faith.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top. Material changes will be flagged on the Site or communicated to active clients by email. Continued use of the Site after an update constitutes acceptance of the updated Terms.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the rest will remain in effect. These Terms, together with our Privacy Policy and any signed Recruiting Services Agreement, are the entire agreement between you and EB Sports Recruiting regarding your use of the Site.
